At China Motion, we want all our users to get the best experience possible from their Mobile Services, with world-class network performance and experience. Our broadband service for instance is delivered over a network shared amongst our users, so we expect our users will not abuse, misuse, exhaust, waste or otherwise take unfair advantage of our consumer telecommunications services to the detriment of other users or China Motion.

Principles :
(a)     Ensure that the speed of our Mobile Service is not adversely effected by extreme usage from a small percentage of users；
(b)     Enable use of high bandwidth applications such as Peer-to-Peer file sharing, but restrict speed for excessive downloads；
(c)     Ensure that well into the future the service doesn’t get congested with people using more than their fair share.

Remedies :
If any user has breached any of the above Fair Use Policy, or China Motion is of the opinion that the manner which an user uses such services will unfairly deprive other users' opportunities of enjoyment or otherwise adversely affect China Motion's interests, China Motion may, with or without notice to such users, take any or all of the following remedial actions:
(d)     suspend or disconnect a particular service to the breaching user;
(e)     restrict the use of a particular service by the breaching user to a reasonable limit (to be specified at China Motion's discretion);
(f)     charge the breaching user for the abused services and/or any services consumed beyond any specified limit at China Motion's prevailing rates; or
(g)     terminate the service contract without liability to China Motion;
provided always that if China Motion exercises any of the above rights, the breaching user shall have no recourse against China Motion.
